New York has received a “double-testing” waiver from the U.S. Department of Education, state officials announced today.

The Empire State’s announcement appears to make it the second state to win a flexi-test waiver from the feds. As we reported previously, in November Montana became the first state to receive a double-testing waiver from certain provisions of the No Child Left Behind Act.

New York’s waiver is narrowly tailored: it applies only to 60,000 middle school students who take the state’s Regents exams in Algebra 1 or geometry. Before the waiver, such students would also have had to take the state’s math assessment for their grade.

The state’s waiver application is posted online.
