The Horne v. Flores case concerning ELLs in Arizona ruled on by the U.S. Supreme Court in June will head back to federal court this month, according to stories by the Associated Press and Arizona Republic.
Timothy Hogan, a lawyer for the Flores side of the case—parents from Nogales Unified School District who have argued programs in Arizona aren't adequate for ELLs—is expected to file a motion by Sept. 30 in U.S. district court in Tucson seeking to expand the case statewide.
Central to the new arguments will be whether Arizona's program that requires English-language learners to receive four hours of instruction in English skills each day is working.
